Returns, Refunds and Privacy

This page describes the return, refund, and privacy practices of A. Allison LLC, doing business as Kula Cloth (“Kula Cloth,” “we,” “us,” or “our”).
Return and Refund Policy
Because many Kula Cloth products are personal hygiene products, we follow strict return requirements to protect the health and safety of our customers.
Please review this policy before opening, washing, handling, or using a product.
Nothing in this policy limits any consumer right or remedy that cannot be waived or restricted under applicable law.
30-Day Voluntary Return Period
Unless a different period is required by applicable law, requests for voluntary returns must be submitted within 30 calendar days of delivery.
The 30-day period begins on the carrier-recorded delivery date. If tracking does not show a delivery date, we may use other reasonable evidence to determine when the order was received.
After the applicable return period has expired, we generally cannot accept a voluntary return or exchange.
This return period is separate from any mandatory rights a customer may have when a product is defective, damaged, misrepresented, or otherwise fails to conform to applicable legal requirements.
Return Eligibility
To qualify for a voluntary return, a product must be:

Completely unused;

Unwashed and unworn;
-
In the same condition in which it was received;
-
Accompanied by all original packaging, tags, components, and accessories;

Accompanied by a receipt or other acceptable proof of purchase; and
-
When supplied with sealed packaging for health-protection or hygiene reasons, completely unopened with the seal intact.
Products sold in sealed packaging for health-protection or hygiene reasons cannot be returned after the seal has been broken where permitted by applicable law.
A hygiene product that has been opened, washed, worn, tested, used, or otherwise exposed to bodily contact cannot be accepted as a voluntary return, even if it was used only once, was washed but not used, or appears clean.
Nonreturnable Products
Unless otherwise required by law, the following products are not eligible for voluntary return or exchange:

Opened hygiene products;

Products with a broken or removed hygiene seal;

Used, worn, tested, or washed products;
-
Products showing moisture, stains, odors, dirt, detergent, pet hair, bodily substances, or other evidence of use or contamination;

Products damaged after delivery;
-
Products damaged through use, laundering, storage, travel, accidents, or improper handling;
-
Products that have been altered, repaired, cut, sewn, personalized, or modified after delivery;
-
Products returned outside the applicable return period;
-
Gift cards; and
-
Products clearly identified as “Final Sale” on the product page or at checkout before purchase.
A product is not automatically final sale merely because it is discounted, promotional, discontinued, or purchased using a coupon. An item is treated as final sale only when it was clearly identified as such before purchase.
Final-sale restrictions do not eliminate any rights involving products that arrive defective, damaged, incorrect, misrepresented, or otherwise protected by applicable law.
Normal Wear and Tear
Normal wear and tear is not considered a manufacturing defect and is not covered by our voluntary return, refund, exchange, or replacement policy.
Normal wear and tear may include:

Fading or changes in color;

Minor changes in texture or softness;
-
Pilling;
-
Fraying caused by repeated use or abrasion;
-
Wear to stitching, edging, snaps, straps, loops, or attachment points;
-
Scratches, scuffs, stains, or surface marks;
-
Stretching or changes in shape;
-
Wear caused by repeated washing or drying;
-
Damage caused by contact with backpacks, gear, branches, rocks, or rough surfaces; and
-
General deterioration resulting from the age or ordinary use of a product.
A product does not qualify for a refund or replacement solely because it has become worn, faded, stained, or damaged during use.
Damage Caused by Use
Damage that occurs during or after use is generally not covered unless we determine that the damage was directly caused by a defect in materials or workmanship that existed at the time of delivery.
Examples of damage that are generally not covered include:

Tears, cuts, punctures, or snags caused during use;

Damage caused by pulling, twisting, abrasion, or excessive force;
-
Damage caused by improper use or care;
-
Damage caused by washing, drying, soaking, or cleaning;
-
Damage caused by bleach, fabric softener, stain treatments, solvents, or other chemicals;
-
Heat, flame, or melting damage;
-
Damage caused by pets, animals, insects, or wildlife;
-
Damage caused by accidents, travel, storage, or outdoor conditions;
-
Damage caused by attaching or securing the product incorrectly; and
-
Products or components that are lost after delivery.
The fact that damage occurs within 30 days of delivery does not by itself establish that the product was defective.
Products That Arrive Damaged, Defective, Incorrect, or Incomplete
Please inspect your order promptly after delivery.
If an item arrives damaged, defective, incorrect, or incomplete, contact us at hello@kulacloth.com as soon as reasonably possible. We ask that initial claims be submitted within 30 days of delivery so that we can investigate the issue promptly.
This requested claim period does not limit any longer period or remedy available under applicable law.
A defect generally means a material or workmanship problem that existed when the product was delivered. Examples may include:

A broken component upon arrival;

A seam that was not properly sewn;
-
Missing hardware or components;
-
A significant construction or printing error affecting the product’s intended function; or
-
Another material or workmanship problem present at delivery.
The following are generally not considered defects:

Normal wear and tear;
-
Accidental damage;
-
Damage caused through use or improper care;
-
Normal differences in print placement;
-
Minor differences in color, stitching, measurements, or appearance; and
-
Variations that do not materially affect the intended function of the product.
When contacting us, please provide:

A description of the issue;

Clear photographs showing the entire product and the reported problem;

Photographs of the packaging and shipping label, when relevant; and
-
Any other information reasonably needed to evaluate the claim.
Please do not wash, use, repair, alter, or discard the affected product while the claim is under review.
Submitting a claim does not automatically establish that the product is defective. We will review the information provided and determine the appropriate response based on the circumstances and applicable law.
Depending on the issue, the available remedy may include:

A replacement;

An exchange;
-
A repair, when appropriate;
-
Store credit;
-
A partial refund; or
-
A refund to the original payment method.
We may require the product to be returned before providing a remedy. We will provide instructions when a return is required.
Incorrect, Missing, or Shipping-Damaged Orders
If your shipment contains an incorrect product, is missing a product, or appears to have been damaged during shipping, email hello@kulacloth.com promptly.
Please include your order number and photographs of:

The products received;

The exterior and interior shipping packaging;

The shipping label;
-
The packing slip, if one was included; and
-
Any visible damage.
Keep the products and packaging until we complete our review.
Requesting a Voluntary Return
Do not mail a product to us before receiving return authorization.
To request a return, email hello@kulacloth.com within the applicable return period and provide:

Confirmation that the product satisfies all return-eligibility requirements.
If your return is approved, we will provide return instructions.

Do not send products to a manufacturer, fulfillment provider, or any other address unless we provide written instructions directing you to do so.
Returns sent without prior authorization may be refused or returned to the sender. If an unauthorized or ineligible product is received, we will contact the customer regarding available options. Additional shipping charges may apply.
Return Shipping
Unless a return results from a confirmed defect, shipping damage, or an error made by Kula Cloth, the customer is responsible for return-shipping costs.
Original shipping charges are generally nonrefundable unless:

The return resulted from an error by Kula Cloth;

The product was damaged or defective when delivered; or
-
Applicable law requires the shipping charges to be refunded.
We recommend using a trackable shipping service and keeping the tracking number and shipping receipt.
Kula Cloth is not responsible for a return that is lost, stolen, delayed, damaged, or misdirected during return transit when the customer selected and arranged the return-shipping service.
Inspection of Returned Products
All returned products are inspected before a refund or exchange is approved.
A voluntary return may be denied if the product:

Has been opened when an intact hygiene seal is required;
-
Has been used, worn, tested, or washed;
-
Is missing packaging, tags, components, or accessories;
-
Shows signs of moisture, contamination, damage, or improper handling;
-
Was returned outside the applicable return period; or
-
Does not otherwise satisfy this policy.
If we receive an ineligible product, we will contact the customer regarding available options. The customer may be responsible for the cost of sending the product back.
Refunds
After an eligible return is received and inspected, we will notify you whether the refund has been approved or denied.
Approved refunds are generally issued to the original payment method.
We cannot issue a refund to a different payment card, bank account, or payment method unless required or permitted by the applicable payment provider or by law.
The time required for a refund to appear depends on the customer’s bank, credit-card issuer, or payment provider.
Unless otherwise required by law or caused by an error by Kula Cloth, the following charges are generally nonrefundable:

Original shipping costs;

Return-shipping costs;

Expedited-shipping charges;
-
Duties;
-
Customs charges;
-
Brokerage charges; and
-
Other delivery-related fees.
Late or Missing Refunds
If we have confirmed that a refund was issued but it has not appeared in your account:

Check the relevant bank, credit-card, or payment account again.

Contact your credit-card issuer or payment provider.

Contact your bank, as posting times vary between financial institutions.

Exchanges
Opened, used, tested, worn, or washed hygiene products cannot be voluntarily exchanged.
An unopened and unused product may be eligible for exchange when:

The request is made during the applicable return period;
-
The product satisfies all return requirements;
-
Any hygiene seal remains intact;
-
The requested replacement is available; and
-
The customer pays any applicable return shipping, replacement shipping, or price difference.
We may process an exchange as a return and ask the customer to place a new order.
Incorrect, damaged, or defective products will be handled under the relevant sections of this policy.
Gifts
A gift may be returned only when it satisfies all applicable return requirements and proof of purchase is available.
If the product was identified as a gift when purchased and shipped directly to the gift recipient, we may issue store credit after receiving and approving the return.
If the product was not identified as a gift, an approved refund will generally be issued to the original purchaser’s payment method.
Gift cards are not refundable except where required by law.
Products Purchased From Other Sellers
Kula Cloth can process returns and refunds only for products purchased directly through kulacloth.com.
Products purchased from another retailer, event, marketplace, wholesale partner, or third-party seller must generally be returned to the original place of purchase and are subject to that seller’s policies.
Claims involving a potential product defect may still be submitted to hello@kulacloth.com, but the available remedy may depend on where and how the product was purchased.
Order Changes and Cancellations
We begin processing orders quickly and cannot guarantee that an order can be changed or canceled after it has been submitted.
Email hello@kulacloth.com as soon as possible if you need to request a change or cancellation.
Once an order has entered fulfillment or has shipped, it generally cannot be canceled. After delivery, the order will be subject to this return policy.
Refused and Undeliverable Packages
An order returned because of an incorrect or incomplete address, refusal of delivery, failure to retrieve the package, or another circumstance outside Kula Cloth’s control may be refunded only after the package is returned to us.
Original shipping charges and return-to-sender fees may be deducted from the refund where permitted by law.
A returned hygiene product must remain unopened, unused, and sealed in its original packaging to qualify for a voluntary refund.
International Customers and Mandatory Consumer Rights
Customers in some countries or regions may have mandatory cancellation, withdrawal, conformity, or product-guarantee rights.
Nothing in this policy is intended to exclude, restrict, or replace rights that cannot legally be waived.
When mandatory local law gives a customer rights that are more favorable than this voluntary policy, the mandatory local law will apply.
Customers located in the European Economic Area, United Kingdom, or another jurisdiction with statutory withdrawal rights should also review our applicable withdrawal instructions and withdrawal form.
The hygiene exception will be applied only where permitted by applicable law, including where sealed products are not suitable for return for genuine health-protection or hygiene reasons after the seal has been broken.
Suspected Fraud or Policy Abuse
We may deny or limit a voluntary return, exchange, refund, or replacement when we reasonably believe a request involves:

Material misrepresentation;

Abuse of this policy;

Excessive or irregular return activity;

Altered evidence;

A product not purchased from Kula Cloth or an authorized seller; or

Another violation of our applicable terms.
This section does not limit any nonwaivable consumer right.
Proof of Purchase
A receipt, order confirmation, or other acceptable proof of purchase is required for voluntary returns, refunds, and exchanges.
We may also request proof of purchase when investigating a damaged or defective product claim.
